Dealer "Unwind"

Here's the situation:

Recently, I went on the MyFord site to register my two month old car and encountered a problem doing so. Upon calling the number posted and speaking to a representative, I was informed that it was already registered. She asked for my info, then asked me if I was the new owner. I replied that I just purchased the car two months ago, NEW, so I am (and should) be the first and only owner. She then stated that there's a previous owner on record to whom it shows it being registered to. She explained to me that it could've been an "unwind" (car was purchased but for some reason, deal did not go through). She suggested I go back to the dealer and find out.

I thought that a CarFax would at least confirm or negate this information so I proceeded to a dealer in close proximity and spoke to a Finance Manager. I explained the situation to him and he gave me the same response that I have already heard; plus the fact that, that should've been disclosed at the time of sale. In addition, it should NOT have been sold as NEW. And unfortunately, he says, they don't subscribe to CarFax so I would either have to get it on my own or go back to the dealer where I purchased it and clear this up for me. I asked him what, if any, kind of recourse I have... says I need to speak to a lawyer.

I thought I would post this here and find out if anyone would have any thoughts or suggestions on how to proceed with this... anyone heard of this before or been in the same situation??? maybe any lawyers out there wanna help out a fellow "Stanger" in distress??? anyone????

Well, just because the deal didn't go through doesn't mean they actually drove the car off the lot.....right?

While they don't have to tell you WHO owned the car before you I agree that if the previous person actually had possession of the car then I would look at it as now a "used" car instead of a new one. However, maybe dealerships and carfax doesn't say a car is owned by someone unless all the paperwork went through.

The laws very according to state, but usually when a contract is placed on a vehicle, that vehicle is can no longer be sold as new. Many dealers will say that if it has never been titled, but usually it is when a contract is signed.
